We apologize for the intrusion but due to the continued negative media
campaign we felt It was time that we tell our side of the situation. If
you are interested in hearing what we have to say than
[sic] keep reading.
For Immediate Release: 6-11-04
Venice Island Pub - (941) 483-3739
The Venice Island Pub would like to make a public statement addressing
all the allegations in an
article published in the Venice Gondolier
on May 29th and many false statements made by the Venice Company and Hager
Construction over the past few months.
The case against the Venice Island Pub was dismissed on May 27th
[not sure
what case Jernigan is referring to here, but there is an ongoing eviction
proceeding that
is still headed for court -- Ed.].
We believe that this is nothing but a smear campaign and a personal
attack on Mr. Tundo by the Venice Company and Hager Construction. We
feel because the Venice Company has no basis in court they are using the
media to damage the reputation of Mr. Tundo. Up until now Mr. Tundo has
chosen not to engage in this type of mud slinging. However, it is
apparent that The Venice Company and Hager Construction are going to
continue these borderline slanderous and liable
[sic] allegations.
The Venice Company and Hager Construction have accused Mr. Tundo of
making threatening remarks. Mr. Tundo has never made any kind of
threatening remarks. Mr. Tundo is being accused of selling liquor in
the Pub. The product that is used at the Pub to make mixed drinks is a
wine based liquor and is legal to sell with a beer and wine license.
This product is distributed by all major wine distribution companies.
In regards to Mr. Tundo's past; twenty-one years ago as a youth he was
arrested and pleaded no contest to unarmed burglary and grand theft.
After this incident Mr. Tundo has not had as much as a point on his
drivers license. Mr. Tundo has since moved on and worked very hard to
make a better life for himself and his family. Bringing up this
youthful indiscretion is another desperate attempt by The Venice Company
to take away from the real issue at hand; The Venice Company has no
legal standings in their actions against the Venice Island Pub.
The Venice Island Pub has tried on many occasions to work with Hager
Construction and The Venice Company to complete the remodeling of the
building. The Pub has been denied access and the use of our balcony and has not
had adequate parking for eleven months. The Pub has gone without air
conditioning and has been denied access to all outside water sources by
Hager Construction, making daily clean up of the Pub extremely
difficult. The Pub has damage to the ceiling and ceiling tiles from a
leak in the roof. Several requests to The Venice Company to make
repairs have gone unanswered.
In order to keep the building in good order, Mr. Tundo offered to place
ash trays and waste receptacles outside the building and was told by
Hager Construction that he could not.
Mr. Tundo also offered to have both stairwells, the parking lot and all
common areas swept and cleaned each night. Again he was told by Hager
Construction he could not.
Mr. Tundo was also notified by The Venice Company that there would be
tile work done on the second floor and he would have to close the Pub
for a minimum of three days. There were no other tenants in the
building that were notified they would have to close. Mr. Tundo offered
several other options on laying the tile so it would not affect his
business so drastically. Mr. Tundo even offered to open late one
evening so the tile work could be completed.
All the tenants in the building have been denied use of the elevator and
have been without signage for ten months.
Mr. Tundo and his staff have in no way encouraged customers to damage or
deface the building in any way - why would he, no one would come.
It's become clear the allegations made by The Venice Company and Hager
Construction are based on nothing more than stereotyping and personal
vendettas. The Venice Company's claim that there is no lease is without
merit. The Venice Island Pub is the true tenant and we are prepared to
prove it in court.
The Venice Island Pub and Mr. Tundo have been active in giving back to
the community by supporting many non-profit and business organizations.
Mr. Tundo has and will continue to actively serve the community by
maintaining the high level of service and community spirit that has
become standard at this community pub.
